Previously, he said that he would enforce the Canada Health Act which he alleges necessitates the funding of preborn child murder (it does not). As Justice Minister, Morgan showed cowardice and negligence of his duties by refusing to challenge a non-binding ruling by the Saskatchewan Court of Appeals which told his ministry that the government must force Saskatchewan marriage commissioners to perform homosexual "marriages", or else fire them. Orginally, Morgan had been working with his government to find a solution that protected the religious freedom and conscience rights of Saskatchewan marriage commissioners, but after the court "reference", he decided to abandon the commissioners to the tryanny of gay "marriage".

In the legislature, Morgan spoke favourably about a recommendation on scrapping that province's controversial Human Rights Tribunals and having human rights cases heard by the regular court system instead: "This is a recommendation that's come forward and is a recommendation that, in fact, may have some merit. There are criticisms that the Saskatchewan Human Rights Tribunal may be seen as too close to the Saskatchewan Human Rights Commission… having the courts handle human rights complaints will increase the perception of fairness, while adding a level of expertise by allowing judges to hold these hearings... hearings that follow the formal rules of evidence that are followed in court, which should improve public confidence in the hearing process." Morgan responded with a cowardly response, to a letter sent to him by Maurice Vellacott, MP for Saskatoon-Wanuskewin, in which the MP expressed his concern with the court’s ruling that the Saskatchewan provincincial gov't must force marriage commissioners to "wed" homosexuals, or else fire them. Vellacott had argued that the court decision violated the provisions of the 2005 Civil Marriage Act, the federal law which implemented same sex 'marriage' in Canada. That law specifically included a provision intended to protect freedom of conscience and religion: “the court has suggested that even if we did establish a single entry point system, it may not stand up in court in any event...
