NOTICE OF CONSTITUTIONAL QUESTION

The question is to be argued by video conference at the following location: 
 
Zoom link to be provided by a staff member of the Ontario Teachers College on the morning of the hearing on Wednesday the 4th day of September, 2024 at 6:30 am Pacific time, 9:30 am Eastern time.
 
The Defendant Michael Del Grande intends to question the constitutional validity or applicability of subsections 1(18) and 1(19) of Ontario Regulation 437/97 (last amended 619/20) (specific acts constituting professional misconduct) of the Ontario College of Teachers Act, 1996, S.O. 1996, c. 12 (herein the OTC Act); and s. 14(1) and
14(5) of the OTC Act (asserting jurisdiction over a member in good standing who is not practicing or employed in the teaching profession, and further claims various remedies, including a dismissal of proceedings, costs, damages and declarations under subsection 24 (1) and s. 52(1) of the Canadian Charter of Rights and Freedoms in relation to absolute privilegethe separation of powers doctrinethe ignorance of the law maximthe void for vagueness principle of fundamental justice, and the jurisdiction, investigation and prosecution of himself by the Ontario Teachers College alleged professional misconduct in the good faith exercise of his oath of office and in his capacity as a good faith defender of the Catholic faith, pursuant to s. 93 of the Constitution Act, 1867, and for violations of his s. 2, 3, 6(2)(b), 7 and 15 Charter rights, that are also protected by absolute privilege, as an elected Catholic School Board Trustee.
